TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (“Terms”) govern all purchases of products and services from Ballard Arms LLC, a Washington limited liability company doing business as Ballard Supply Co. (“Company,” “we,” “us,” or “our”), through the website located at ballardsupplyco.com (the “Site”), in person, or by any other method. By placing an order with us, you (“Customer,” “you,” or “your”) agree to be bound by these Terms.

1. Eligibility and Age Requirements
All firearm purchases are subject to federal and Washington State age requirements. You must be at least twenty-one (21) years of age to purchase a pistol, pistol frame, or semiautomatic rifle (RCW 9.41.240). You must be at least eighteen (18) years of age to purchase other long guns (e.g., bolt-action rifles, shotguns) unless otherwise restricted by law. You represent and warrant that you are legally eligible to purchase and possess firearms under all applicable federal, state, and local laws, including but not limited to 18 U.S.C. § 922(g), RCW 9.41.040, and RCW 9.41.240.

2. Firearm Safety Training and Permit to Purchase Requirements
Washington State currently requires all firearm purchasers to provide proof of completion of a recognized firearm safety training program completed within the five (5) years preceding the purchase application (RCW 9.41.1132). You must present proof of training at the time of purchase. We cannot complete any firearm transfer without valid training documentation or proof of an applicable exemption under RCW 9.41.1132(5).
Effective May 1, 2027, Washington State will transition to a permit-to-purchase system under RCW 9.41.121 (as enacted by 2025 Wash. Sess. Laws ch. 370 / HB 1163). Under the new system, firearm safety training will be completed as part of the permit application rather than presented at each transfer, and you will be required to present a valid permit to purchase issued by the Washington State Patrol. We will update our transfer procedures in accordance with the new requirements as the effective date approaches. You are responsible for confirming and satisfying the requirements in effect at the time of your purchase.

3. Background Checks and Waiting Periods

All firearm sales and transfers are subject to a background check conducted through the Washington State Patrol Firearms Background Check Program, which includes queries to NICS, WSP databases, the Health Care Authority, the Administrative Office of the Courts, and other resources as required by RCW 9.41.090.

Washington State law imposes a mandatory ten (10) business-day waiting period from the date the background check is initiated before any firearm may be delivered (RCW 9.41.092). Delivery is further contingent upon the background check returning an eligible result. We will notify you when your firearm is available for pickup. Orders may not be canceled solely due to the duration of the background check or waiting period.

4. Compliance with Federal, State, and Local Firearms Laws

You acknowledge and certify that you fully understand and will comply with all applicable federal, state, city, and county laws, regulations, and ordinances (“Firearms Laws”) governing the purchase, possession, transfer, assembly, manufacture, and use of firearms, frames, receivers, and related products (“Products”).

You agree and certify that you will not assemble, possess, convert, manufacture, import, distribute, offer for sale, sell, or otherwise transfer any Product in violation of Firearms Laws. Without limiting the generality of the foregoing, you acknowledge the following Washington State restrictions:

  • The sale, manufacture, distribution, and importation of assault weapons as defined in RCW 9.41.010(2) is prohibited (RCW 9.41.390), though possession of lawfully owned assault weapons remains legal.
  • The sale, manufacture, distribution, and importation of large-capacity magazines (more than 10 rounds) is prohibited (RCW 9.41.370).
  • Secure storage requirements apply when a prohibited person or minor could access a firearm (RCW 9.41.360).
  • All private firearm transfers must be conducted through a licensed dealer with a background check (RCW 9.41.113), with limited exceptions for transfers between immediate family members and other categories defined by statute.
  • Additional Washington statutes governing firearm industry conduct, including public nuisance provisions under Chapter 7.48 RCW, may apply to the manufacture, sale, marketing, and distribution of firearms and related products.

5. Straw Purchase Prohibition

A straw purchase occurs when an individual purchases a firearm on behalf of another person who may be ineligible to purchase or possess firearms, or who seeks to bypass legal requirements such as background checks. Under the Gun Control Act of 1968 (18 U.S.C. § 922) and Washington State law (RCW 9.41), straw purchases are illegal and punishable by up to ten (10) years in federal prison and fines of up to $250,000, plus additional state penalties.

You represent and warrant that you are the actual purchaser of any firearm ordered from us and that you are not purchasing any firearm on behalf of any other person. Our team is trained to identify indicators of straw purchases, and we reserve the right to refuse any sale and report suspected straw purchases to the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and local law enforcement.

6. Product Descriptions and Pricing

We strive to ensure that all product descriptions, images, and pricing on the Site are accurate. However, we do not warrant that descriptions, images, or pricing are error-free, complete, or current. In the event of a pricing error, we reserve the right to cancel any order placed at an incorrect price and will notify you promptly. We may correct errors or update information at any time without prior notice.

All prices are in U.S. dollars and are exclusive of applicable taxes unless otherwise stated. Washington State retail sales tax will be collected at the rate applicable to the delivery location, as required by RCW 82.08.020.

7. Order Acceptance and Cancellation

Your placement of an order constitutes an offer to purchase. We reserve the right to accept or reject any order, in whole or in part, for any reason, including product availability, pricing errors, suspected fraud, or suspected violations of Firearms Laws. An order is not accepted until we confirm it in writing (including by email or text message).

Due to the nature of federally regulated products, once a background check has been initiated for a firearm purchase, the order may not be canceled. For non-firearm products, cancellation requests may be submitted prior to shipment by contacting us at support@ballardsupplyco.com.

8. Payment Terms

Payment is due at the time of order unless otherwise agreed in writing. We accept the payment methods listed on the Site. All payments are non-refundable except as expressly provided in these Terms. Background check fees charged by the Washington State Patrol or other governmental agencies are non-refundable regardless of outcome.

9. Pickup and Delivery

All firearm transfers must be completed in person at our licensed premises or through a receiving Federal Firearms Licensee (FFL), in compliance with ATF regulations and RCW 9.41.090. We will schedule a pickup appointment after your background check is approved and the mandatory waiting period has elapsed. You must present valid government-issued photo identification at the time of pickup.

Risk of loss and title for all Products pass to you upon delivery or pickup. We are not responsible for delays caused by background check processing, governmental action, carrier delays, force majeure, or other circumstances beyond our reasonable control.

10. Return and Refund Policy

Firearms, frames, and receivers: ALL SALES ARE FINAL.

Due to the nature of federally regulated items and the background check and transfer process, we do not accept returns or issue refunds on any firearm, frame, or receiver once the transfer has been initiated, except in the case of a manufacturer defect or a product recall as described in Section 11. This policy is consistent with Washington law, which does not require a refund for non-defective merchandise when the return policy is clearly disclosed (see RCW 19.86.020 and WA Attorney General guidance on retail return policies).

Non-firearm products:

Non-firearm accessories and parts may be returned within fourteen (14) days of delivery if they are unused, in original packaging, and accompanied by proof of purchase. Returns are subject to a restocking fee of up to 15%, which will be disclosed at the time of return authorization. Shipping costs for returns are the responsibility of the Customer unless the return is due to our error or a product defect. Refunds will be issued to the original payment method within ten (10) business days of receiving the returned item.

Defective products:

If you receive a product with a manufacturer defect, contact us within thirty (30) days of receipt. We will work with the manufacturer to facilitate a warranty claim, repair, replacement, or refund as applicable.

11. Product Recall Procedure

In the event of a recall affecting Products we have sold, we will notify affected Customers through available contact methods (email, website announcement, and notices to dealers/distributors). The recall notice will include a description of the affected product, the reason for the recall, and verification instructions.

Recall Return Process

  1. Verify your product is affected by checking our website or contacting customer support.
  2. Contact us at support@ballardsupplyco.com with your proof of purchase and product serial number.
  3. Upon confirmation of eligibility, we will provide a prepaid shipping label with packaging instructions.
  4. Refunds will be processed within ten (10) business days of receipt and inspection of the returned product, equal to the original purchase price less any value reduction attributable to modifications you made to the product.

Products returned outside the specified recall period or not meeting return requirements may be ineligible for refund. We are not responsible for delays caused by modifications made to recalled products by the Customer.

In addition to formal recalls, we will share manufacturer safety bulletins, voluntary design improvement notices, and similar safety communications with affected Customers when received from the manufacturer or distributor. Such communications do not constitute recalls, do not trigger the return and refund procedures set forth above, and do not create any warranty obligation on our part. Customers are responsible for independently evaluating whether to act on any safety bulletin or voluntary upgrade notice.

12. Warranty Disclaimer

Products sold by us are covered by their respective manufacturer warranties, if any. We are not the manufacturer of the Products we sell and make no independent warranties regarding them.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCLUDING THE WASHINGTON UNIFORM COMMERCIAL CODE (TITLE 62A RCW), WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT AFFECT ANY MANUFACTURER WARRANTY THAT MAY ACCOMPANY A PRODUCT.

Nothing in these Terms is intended to limit any non-waivable warranty rights you may have under the Magnuson-Moss Warranty Act (15 U.S.C. §§ 2301–2312) or Washington State law.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL BALLARD ARMS LLC, ITS MEMBERS, OFFICERS, MANAGERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR PURCHASE OR USE OF ANY PRODUCT, WHETHER BASED IN WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions, including Washington State, do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Ballard Arms LLC and its members, officers, managers, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms; (b) your violation of any Firearms Law or other applicable law; (c) your use, assembly, modification, or transfer of any Product; (d) any negligent or wrongful act or omission by you; or (e) any failure to fulfill obligations relating to your account.

We reserve the right to assume exclusive control of the defense of any claim subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

15. Website and Application Usage

By accessing or using the Site, you agree to use it only for lawful purposes and in accordance with these Terms. You agree that:

  • Any information you provide during registration or checkout will be accurate, current, and complete.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
  • You will not use the Site to facilitate any unlawful transaction or violate any applicable law.
  • You will not attempt to gain unauthorized access to any portion of the Site, its servers, or connected networks.
  • You will not use automated systems (bots, scrapers, etc.) to access the Site without our prior written consent.

Product information displayed on the Site is provided for consumer education purposes. The Site does not constitute legal advice. You should consult your state’s Attorney General, local law enforcement, or a licensed attorney for legal guidance specific to your jurisdiction.

16. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Ballard Arms LLC or its content suppliers and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent.

17. Privacy and Data Collection

We collect and process personal information as necessary to complete transactions, comply with federal and state recordkeeping requirements (including ATF Form 4473 and Washington State background check records), and communicate with you about your orders. Our collection and use of personal information is subject to our Privacy Policy, which is incorporated into these Terms by reference.

We do not sell your personal information to third parties. We may disclose information as required by law, including to the ATF, Washington State Patrol, law enforcement agencies, or as otherwise required by Firearms Laws. By placing an order, you consent to the collection and processing of your information as described herein and in our Privacy Policy.

To the extent the Washington My Health My Data Act (Chapter 19.373 RCW) applies, we do not collect, share, or sell consumer health data through the Site.

18. Electronic Communications

By providing your email address, phone number, or other contact information, you consent to receive electronic communications from us regarding your orders, including order confirmations, background check status updates, pickup scheduling, recall notices, and other transactional communications. You may also receive promotional communications; you may opt out of promotional messages at any time by following the unsubscribe instructions included in such communications or by contacting us.

19. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or any transaction with us shall be resolved as follows:

  1. Informal Resolution. You agree to first attempt to resolve any dispute informally by contacting us at support@ballardsupplyco.com. We will attempt to resolve the dispute within thirty (30) days.
  2. Mediation. If informal resolution fails, either party may initiate mediation administered by a mutually agreed-upon mediator in King County, Washington. Mediation costs shall be shared equally.
  3. Litigation. If mediation is unsuccessful, either party may file a claim in the state or federal courts located in King County, Washington. You consent to the personal jurisdiction of such courts.

Nothing in this section limits your right to file a complaint with the Washington State Attorney General’s Consumer Protection Division, the ATF, or any other governmental agency.

To the maximum extent permitted by law, any claim arising under these Terms must be brought within one (1) year of the date the cause of action accrues, or it is permanently barred.

20. Force Majeure

We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, fire, flood, earthquake, pandemic, governmental action, changes in law or regulation, labor disputes, supply chain disruptions, utility failures, or carrier delays.

21. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on the Site with an updated effective date. Your continued use of the Site or placement of orders after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

22. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

23. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and Ballard Arms LLC with respect to the subject matter hereof and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

24. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Ballard Arms LLC.
